Court backs advertising ban on weight-loss drug

A PHARMACEUTICAL company has lost its Federal Court battle to overturn an advertising ban on a controversial weight-loss drug.

A federal health committee voted in February to ban advertising for Xenical after complaints that it was being marketed extensively during television shows that appealed to young people, and that pharmacists were dispensing it to customers who were not overweight or obese.

The drug’s manufacturer, Roche, challenged the advertising ban, arguing it was against public health interests, but its application was dismissed yesterday by Justice Catherine Branson.

“I reject the submission that the committee breached its limits … by having regard to the alleged experiences and practices of some pharmacists in dispensing orlistat [Xenical] to consumers,” she said.

“Information before the committee … was capable of being regarded by the committee as relevant to not only the extent and patterns of the use of the substance but also the potential for abuse of the substance and the purposes for which a substance is to be used.”

The consumer watchdog Choice had complained last year that Xenical, known to have serious side effects such as diarrhoea and incontinence, was being advertised extensively during Australian Idol on Channel Ten. Idol, Ten says, captures more than 50 per cent of the 16- to 39-year-old audience.

Greta Kretchmer, of the Eating Disorders Foundation, said “people of normal weight, many … with eating disorders” were having no trouble buying Xenical over the counter.

Roche voluntarily withdrew its TV ads in November and modified its campaign to “specifically highlight that Xenical is not suitable for everyone”. Those ads went back on air a month ago but yesterday’s ruling means the drug cannot be advertised directly to the public at all.

Upstate Camp Helps Kids Who Struggle With Childhood Obesity, Part 1

It is a serious health crisis that experts say could shorten the lifespan of young people for the first time in generations. In the past few decades, along with adults, rates of obese and overweight kids have more than doubled. In the first of a two-part series, NY1 Health & Fitness reporter Kafi Drexel visits a camp that seems to have been tackling the issue just as long as the epidemic’s been growing.

Just over 100 miles outside New York City, nestled in the Catskill Mountains, you’ll find Camp Shane. Shane, derived from a Yiddish term for “beautiful” has been a summer weight loss camp for children and young adults for nearly 40 years.

And part of the story of the nation’s growing struggle with weight could be told right here: when the camp started in 1968, they had just 21 campers. But in recent years, that number has swelled to more than 800.

David Ettenberg’s parents started the camp, and he still runs it today.

“There are a whole lot more kids with weight loss issues than there was 20 years ago,” says Ettenberg. “I think there is a much more greater awareness of the problems that come with that. It’s sort of a complex situation. While more people know about it, they don’t know what to do.”

At camp, the lifestyle change for most of the kids is drastic. They’re engaged in constant physical activity almost from the moment they wake until they go to sleep at night. In between, they break for group nutrition and counseling sessions. And all their meals are strictly portion controlled, with no sharing allowed, and counselors close by making sure campers aren’t eating too much, or too little.

If the exercise activities alone weren’t enough, the physical layout of this camp could also be having an impact on these kids. You could probably burn off part of lunch, just trying to climb up a hill.

Ask most of the kids, and many will say, coming to camp was actually their decision.

“I made the choice to come here, because I’m really sick and tired of being overweight. And it’s been a problem for me ever since I was younger,” says 15-year-old camper Nicole Carroll. “I don’t want diabetes. I don’t want any of that stuff because it’s horrible. I don’t want to live the rest of my life with those problems, and I don’t want to die earlier than I have to.”

“It’s for myself. I want to feel better about myself,” says 14-year-old camper Inessa Tsidulko. “Not many people pick on me back home, but I feel like I don’t fit in completely with my friends who are smaller than me, and I just want to feel better about myself.”

It is a life choice that’s not just about losing weight, but gaining self-esteem needed for building the healthier lifestyles to guarantee success.

Refunds for ‘weight loss’ drug

f you thought Xenadrine EFX would be a “powerful fat-loss catalyst” but were unhappy with the results, you’re entitled to a refund, thanks to the folks at the Federal Trade Commission.

Xenadrine The FTC alleged that Xenadrine EFX was advertised with false and unsubstantiated weight-loss claims, and its settlement with the marketers of Xenadrine EFX included money for consumer refunds.

The refund is good through Sept. 15 and the amount will depend on the number of consumers who request refunds.

And while I like to see the FTC cracking down on false advertising, the “additional notes” on the company’s Web site (below), should have been enough to discourage anyone from taking it in the first place. (Not surprisingly, the clickable categories “testimonials” and “clinical studies” are currently unavailable.)

Agora, a newsletter publishing company based in Baltimore, has found a novel way to encourage better lifestyle choices by its employees: a 12-week weight-loss contest. The reward: a $1,000 prize for the top “losers” in male, female and team categories.

By the time the contest ended Friday, 84 employees had shed nearly 1,000 pounds, with two losing more than 40 pounds each.
Fitness programs and weight-loss competitions such as Agora’s, which was inspired by the NBC show “The Biggest Loser,” are becoming more popular in offices, where workers are concerned about their waistlines and employers about health-care costs. The goals are to improve employee health, increase productivity, reduce absenteeism and lower costs.
“The concept is becoming more popular as workplaces realize the cost of an obese work force,” said Marci Campbell, an associate professor in the nutrition department at the University of Northern Carolina.
Agora spent $90,000 for the program, which was extended another 12 weeks. Employees can work with personal trainers during classes at the company’s gym or have unlimited access to a local gym.

More workers call EAPs about nonwork matters
The number of calls from workers turning to employee assistance programs and helplines for assistance with personal issues increased significantly in the first half of 2007, says a national EAP and helpline provider.
Bensinger, DuPont & Associates says it received 6,500 calls — a 74 percent increase — for short-term problem resolution in 2007, compared with the same time in 2006, according to a report Tuesday on the Web site of the Society of Human Resource Managers.
Bensinger, DuPont attributed the increase to the expanding scope of EAP services that provide confidential assistance 24 hours a day, seven days a week, as well as employees’ increasing willingness to seek help

Oregon Attorney General Sues L.A. Weight Loss

Oregon Attorney General Hardy Myers is suing L.A. Weight Loss, alleging the company makes misleading claims to consumers. Colin Fogarty reports.

The Oregon Department of Justice says L.A. Weight Loss violated the state’s Unlawful Trade Practices Act.

The suit claims that the company’s ads say the program costs only nine dollars a week, when in fact consumers are required to pay several hundred dollars up front to sign up.

Valerie Bertinelli to Write Memoir

Valerie Bertinelli has held many titles: sitcom star, rock-star wife – and now, author.

Bertinelli, 47, who talked to PEOPLE in April about her weight battle, will write a memoir called “Losing It: And Gaining My Life Back One Pound at a Time.” The book will be published in April 2008.

Bertinelli’s memoir also will delve into her life as a teenage TV star and her 20-year marriage to rock legend Eddie Van Halen, which ended in divorce in 2005. But memoir will center on her challenges with weight loss and self-esteem issues.

“Writing a book is an exciting new adventure for me,” Bertinelli said in a statement from her publisher, the Free Press.

In April, she vowed to PEOPLE that she would lose 30 lbs. by September.

With her Jenny Craig gig, Bertinelli took a step back into the media spotlight, but with her memoir, she says she’s not afraid of opening the door to her private life.

“I’ve grown up in and out of the public eye, survived some tough times, learned some important lessons, and come out – as has my entire family – in a great place,” she said in the statement.
